AGREEMENT TO OUR LEGAL TERMS

These Terms and Conditions (“Legal Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you,” “Patient,” or “User”), and Aspen Aesthetics, LLC, dba Fifty 410 Health (“Company,” “we,” “us,” or “our”), concerning your access to and use of our website (www.fifty410.com), telehealth platform, prescription medication facilitation, and all related services (collectively, the “Services”). These Legal Terms also incorporate by reference our Privacy Policy, Telehealth Informed Consent, and Refund Policy. The applicable HIPAA Notice of Privacy Practices is provided separately by your treating Provider or dispensing pharmacy during the patient-care process.

YOU AGREE TO THESE TERMS WHEN YOU AFFIRMATIVELY ACCEPT THEM, INCLUDING BY CHECKING THE AGREEMENT BOX BEFORE CONTINUING TO THE INTAKE OR BY COMPLETING A TRANSACTION AFTER THE TERMS ARE PRESENTED. MERELY VIEWING A PUBLIC WEBPAGE DOES NOT, BY ITSELF, CONSTITUTE AGREEMENT TO ARBITRATION. IF YOU DO NOT AGREE, DO NOT CONTINUE TO THE INTAKE OR PURCHASE THE SERVICES.

We reserve the right to update or modify these Legal Terms at any time. The modified Legal Terms will become effective upon posting on our website or upon notification to you at the email address on file. By continuing to use the Services after the effective date of any changes, you agree to be bound by the modified terms. It is your responsibility to review these Legal Terms periodically.


1. NATURE OF SERVICES; MEDICAL DISCLAIMERS; REGULATORY DISCLOSURES

1.1 Platform Description

Fifty 410 Health operates a telehealth platform that facilitates connections between patients and independently licensed healthcare providers (“Providers”) for the evaluation, diagnosis, and potential prescription of medications. Fifty 410 Health is NOT a medical practice, healthcare provider, pharmacy, drug manufacturer, or compounder. Fifty 410 Health does not practice medicine, prescribe medications, dispense drugs, or provide medical advice. All clinical decisions, including whether to prescribe any medication, are made solely by the independent licensed Provider who evaluates you.

1.2 Independent Providers

The Providers accessible through the Services are independent licensed healthcare professionals. They are not employees, agents, or representatives of Fifty 410 Health. Your use of the Services creates a provider-patient relationship solely between you and the Provider who evaluates and treats you. No doctor-patient, employer-employee, or agency relationship is created between you and Fifty 410 Health by virtue of your use of the Services.

1.3 Compounded Medications Disclosure

IMPORTANT: Certain medications that may be prescribed through the Services are compounded preparations. YOU ACKNOWLEDGE AND UNDERSTAND THAT:

  • Compounded medications are prepared for individual prescriptions by independent compounding pharmacies.
  • Compounded medications are not represented as generic versions of, equivalent to, or substitutes for branded medications.
  • Compounded medications are prepared by independently licensed compounding pharmacies pursuant to patient-specific prescriptions in compliance with applicable provisions of Section 503A of the Federal Food, Drug, and Cosmetic Act, as well as state pharmacy laws.
  • Fifty 410 Health does not manufacture, compound, label, or distribute any medications. All compounding is performed by independently licensed pharmacies.
  • The decision to prescribe a compounded medication is made solely by the licensed Provider based on their clinical judgment that a compounded preparation is medically appropriate for you as an individual patient.
  • There may be risks, side effects, and limitations associated with compounded medications.

1.4 No Guarantee of Prescription or Results

Fifty 410 Health does not guarantee that any Provider will prescribe any particular medication or treatment. All prescribing decisions are at the sole discretion of the licensed Provider.

INDIVIDUAL RESULTS VARY. NO SPECIFIC WEIGHT LOSS, HEALTH IMPROVEMENT, OR THERAPEUTIC OUTCOME IS GUARANTEED OR IMPLIED. Outcomes depend on numerous factors including adherence to the prescribed treatment plan, diet, exercise, genetics, pre-existing conditions, and individual physiology.

1.5 Not Emergency Care

THE SERVICES ARE NOT INTENDED FOR USE IN MEDICAL EMERGENCIES. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR GO TO THE NEAREST EMERGENCY ROOM IMMEDIATELY.

The Services are not a substitute for an in-person relationship with your primary care physician or specialist and should not be used as a replacement for professional medical advice, diagnosis, or treatment.

1.6 Informational Content Disclaimer

All content provided on our website, marketing materials, social media, emails, and other communications—including text, graphics, images, videos, testimonials, and information—is for general informational purposes only and does not constitute medical advice, diagnosis, or treatment. Any testimonials or before-and-after images represent individual experiences and are not indicative of typical results.

1.7 Treatment Risks and Informed Consent

BY USING THE SERVICES TO OBTAIN PRESCRIPTION MEDICATIONS, YOU ACKNOWLEDGE AND ACCEPT THE FOLLOWING:

  • Prescription medications may involve risks, side effects, contraindications, and drug interactions.
  • Your prescribing Provider has discussed or will discuss the risks, benefits, and alternatives of your prescribed treatment with you, and you consent to such treatment.
  • You are responsible for reading all medication guides, patient information sheets, and pharmacy instructions provided with your medications.
  • You understand that accepting treatment does not guarantee a particular outcome.
  • You will promptly report any adverse effects, changes in health status, or concerns to your Provider and, if applicable, to emergency services.
  • You will not use medications obtained through the Services for any purpose other than as prescribed by your Provider.

This acknowledgment does not waive any right or remedy that cannot legally be waived, and it does not release Fifty 410, a Provider, a pharmacy, or any other person from liability for gross negligence, willful misconduct, professional malpractice, bodily injury, or any other liability that applicable law does not permit to be limited or released.

1.8 Regulatory Compliance

Fifty 410 Health is committed to compliance with all applicable federal and state laws and regulations, including those enforced by federal and state regulators, state boards of medicine, state boards of pharmacy, and other regulatory bodies. The availability of specific medications and services through the platform may change at any time in response to regulatory developments. Fifty 410 Health reserves the right to modify, suspend, or discontinue any medication offering or service at any time without prior notice to comply with applicable law.


2. ELIGIBILITY AND USER REPRESENTATIONS

By using the Services, you represent and warrant that:

  • You are at least eighteen (18) years of age.
  • You are a legal resident of the United States and are physically located in a state where the affiliated Providers are licensed to practice at the time of your consultation.
  • You have the legal capacity to enter into a binding agreement.
  • All registration information, medical history, health information, and other data you submit is truthful, accurate, current, and complete.
  • You will maintain the accuracy of such information and promptly update it as necessary.
  • You are seeking the Services for your own personal medical use and not on behalf of any other person (unless legally authorized).
  • You are not obtaining medications through the Services for resale, redistribution, recreational use, or any unlawful purpose.
  • You have disclosed all current medications, allergies, pre-existing medical conditions, and relevant health history to your Provider.

If any information you provide is untrue, inaccurate, not current, or incomplete, we reserve the right to immediately suspend or terminate your account, cancel pending orders, and refuse any and all current or future use of the Services.


3. ACCOUNT REGISTRATION AND SECURITY

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to immediately notify us at [email protected] of any unauthorized use. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

You may not use another person's account, allow another person to use your account, or share login credentials. Because the Services involve prescription medications and protected health information, unauthorized account access may constitute a violation of federal and state law.


4. PRESCRIPTION MEDICATIONS AND PHARMACY SERVICES

4.1 Prescription Process

If a licensed Provider determines that prescription medication is appropriate for you, the prescription will be transmitted to one of our affiliated licensed compounding or retail pharmacies for dispensing. Fifty 410 Health acts solely as a facilitator and does not control, influence, or guarantee the Provider's prescribing decisions or the pharmacy's dispensing practices.

4.2 Third-Party Pharmacies

All prescription medications are dispensed by independently licensed and operated pharmacies. Fifty 410 Health does not manufacture, compound, label, package, or dispense medications. Fifty 410 Health is not responsible for the acts, omissions, errors, or negligence of any affiliated pharmacy.

4.3 No Guarantee of Availability

Medication availability is subject to change without notice due to supply chain disruptions, regulatory changes, pharmacy capacity, or other factors beyond our control.

4.4 Patient Responsibilities

You are solely responsible for:

  • Providing complete, accurate, and current medical history, including all current medications, supplements, allergies, and pre-existing conditions.
  • Following your prescribing Provider's instructions for medication use, dosage, titration, storage, administration, and disposal.
  • Attending all required follow-up consultations and check-ins as directed by your Provider.
  • Promptly reporting any adverse effects, changes in health status, new diagnoses, or new medications to your Provider.
  • Storing all medications according to manufacturer and pharmacy guidelines, including cold-chain storage requirements.
  • Not sharing, selling, transferring, or distributing prescription medications to any other person.
  • Properly disposing of unused or expired medications in accordance with pharmacy instructions and applicable requirements.
  • Obtaining necessary lab work or diagnostic testing as directed by your Provider.

5. THIRD-PARTY SERVICE PROVIDERS AND INTEGRATIONS

To deliver the Services, Fifty 410 Health works with various third-party service providers, which may include:

  • Licensed telehealth healthcare Providers and medical groups.
  • Licensed compounding and retail pharmacies.
  • Laboratory testing partners for blood work and diagnostic panels.
  • Payment processors for secure transaction handling.
  • Patient intake and electronic health record (EHR) platforms.
  • Communication platforms for appointment reminders, health notifications, and marketing.
  • Shipping and logistics providers for medication delivery.
  • Identity verification services.

Fifty 410 Health is not responsible or liable for the acts, omissions, errors, delays, or negligence of any third-party service provider. Your use of third-party services may be subject to their separate terms and privacy policies.


6. PAYMENT, BILLING, AND REFUND TERMS

6.1 Pricing and Fees

All pricing is listed on our website in U.S. Dollars and is subject to change at any time without prior notice.

6.2 Payment Authorization

By purchasing the Services, you authorize Fifty 410 Health and its payment processor(s) to charge the payment method on file for all amounts due.

6.3 Cancellations, Refunds, Replacements, and Credits

Our Refund Policy is incorporated into these Terms and is the controlling policy for cancellations, refunds, replacements, and credits. In summary, an eligible order may be canceled for a full refund after payment only if the cancellation is received and confirmed before the dispensing pharmacy begins compounding. Once compounding begins, routine cancellations and refunds are not available. Verified fulfillment or billing issues—including an inability to fulfill, duplicate charge, incorrect order, damage, loss, non-delivery, temperature concern, or partial fulfillment—are handled under the exceptions and procedures stated in the Refund Policy.

6.4 Chargebacks and Payment Disputes

We encourage you to contact Fifty 410 first so we can investigate a billing concern promptly. Nothing in these Terms limits a good-faith right to dispute a charge with your card issuer or financing provider. Fifty 410 may provide accurate transaction and fulfillment records to the applicable financial institution and may pause unpaid, non-emergency Services while a payment dispute is pending, to the extent permitted by law. We will not penalize a patient merely for submitting a good-faith billing dispute.

6.5 Failed Payments

If a payment fails, we may attempt to process the charge again. If payment cannot be collected, we reserve the right to suspend or terminate your access, cancel pending prescriptions or shipments, and pursue collection.


7. SHIPPING AND DELIVERY

7.1 Shipping Methods

Prescription medications will be shipped directly from the dispensing pharmacy to your address. Fifty 410 Health does not guarantee specific delivery dates or times.

7.2 Temperature-Controlled Shipping

Certain medications require temperature-controlled (cold-chain) shipping.

YOU ARE SOLELY RESPONSIBLE for promptly retrieving delivered medications and properly storing them upon arrival. Fifty 410 Health shall have no liability for any compromise resulting from failure to do so.

7.3 Risk of Loss

Risk of loss and title pass to you upon delivery. Fifty 410 Health is not liable for packages lost, stolen, or damaged after delivery. Delivery issues must be reported within forty-eight (48) hours.

7.4 Address Accuracy

You are solely responsible for providing a correct shipping address. Re-shipment costs for address errors are your responsibility.


8. INTELLECTUAL PROPERTY RIGHTS

8.1 Company Intellectual Property

We are the owner or licensee of all intellectual property rights in the Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (the “Content”), as well as our trademarks, service marks, and logos (the “Marks”).

8.2 Limited License

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable, limited license to access the Services and download or print Content solely for your personal, non-commercial use.

8.3 Third-Party Trademarks

All third-party product names, brand names, and trademarks are the property of their respective owners. Fifty 410 Health offers compounded medications only, which are not FDA-approved, and is not affiliated with, endorsed by, or sponsored by any manufacturer of FDA-approved medications. Fifty 410 Health does not sell, and does not claim equivalence to, any branded product.

8.4 Your Submissions

You retain ownership of content you submit to us. You grant Fifty 410 a non-exclusive, worldwide, royalty-free license to host, reproduce, and display a Submission only as reasonably necessary to operate the Services, respond to your request, or use the Submission in a manner you separately authorize.

Consumer reviews and testimonials are excluded from any automatic license or assignment. We may feature a review or testimonial in marketing only with separate permission or another lawful right to do so. Nothing in these Terms restricts your right to publish an honest review or opinion about Fifty 410, its Services, or your experience.


9. PROHIBITED ACTIVITIES

As a user of the Services, you agree not to:

  • Provide false personal information, medical history, or identity documents to obtain medications.
  • Obtain medications for another person, for resale, or for any non-medical or recreational purpose.
  • Share, sell, transfer, or distribute prescription medications obtained through the Services.
  • Systematically retrieve data from the Services without written permission.
  • Trick, defraud, or mislead us, our Providers, pharmacies, or other users.
  • Circumvent, disable, or interfere with security-related features.
  • Harass, abuse, threaten, or harm any person, including our employees, agents, or Providers.
  • Use the Services inconsistently with any applicable laws or regulations.
  • Upload or transmit viruses, malware, or other harmful material.
  • Engage in automated use of the system without authorization.
  • Attempt to impersonate another user, person, or entity.
  • Interfere with or create an undue burden on the Services.
  • Attempt to bypass access restrictions or reverse engineer our software.
  • Use the Services to generate competing products or services.
  • Initiate chargebacks or payment disputes in bad faith.
  • Knowingly post unlawful content or content that infringes another person's rights.

10. HEALTH INFORMATION, HIPAA, AND PRIVACY

10.1 Protected Health Information (PHI)

PHI created or maintained as part of your care is governed by the applicable HIPAA Notice of Privacy Practices issued by your treating Provider or dispensing pharmacy. That notice is provided separately during the patient-care process.

10.2 Business Associate Relationships

When Fifty 410 or one of its service providers handles PHI on behalf of a HIPAA covered entity, that handling is subject to applicable contractual and legal requirements, including a Business Associate Agreement where required. Providers, pharmacies, and laboratories remain responsible for their own independent legal and professional obligations.

10.3 General Privacy Policy

Please review our Privacy Policy, which is incorporated into these Legal Terms.

10.4 Data Hosting and Transfer

The Services are hosted in the United States. If you access the Services from any other region, you expressly consent to the transfer, storage, and processing of your data in the United States.

10.5 Data Sharing

Your information may be shared with affiliated Providers, pharmacies, laboratories, payment processors, and shipping providers as necessary for treatment, payment, healthcare operations, and fulfillment, as permitted by applicable law and the relevant privacy notices.

10.6 De-Identified and Aggregated Data

We may use de-identified or aggregated data for research, analytics, quality improvement, and business purposes.


11. TELEHEALTH INFORMED CONSENT

By using the Services, you acknowledge and consent to the following:

  • Telehealth involves the use of electronic communications to provide clinical health care services at a distance.
  • Telehealth has limitations compared to in-person visits, including the inability to perform physical examinations.
  • There are potential risks including technology failures, interruptions, and unauthorized access to health information.
  • You have the right to decline or withdraw from a telehealth consultation at any time.
  • Confidentiality laws apply to telehealth interactions.
  • You are responsible for ensuring a private, well-lit environment for video consultations.
  • You consent to the Provider making prescribing, treatment, and referral decisions based on the telehealth encounter.
  • If in-person evaluation is needed, you agree to seek such care as directed.

12. ADVERTISING, MARKETING, AND TESTIMONIAL DISCLAIMERS

Fifty 410 Health may engage in advertising and promotional activities. You acknowledge and agree that:

  • All marketing materials are for informational purposes only and do not constitute medical advice or a guarantee.
  • Fifty 410 Health does not claim that any compounded medication is the same as, equivalent to, or a substitute for any branded medication.
  • Any testimonials, reviews, or before-and-after images represent individual experiences and are not indicative of typical results.
  • Influencer or affiliate endorsements do not constitute medical advice and may reflect compensated relationships.
  • Fifty 410 Health is not responsible for unauthorized third-party content, advertisements, or statements.

13. USER CONTENT AND CONTRIBUTION LICENSE

By submitting suggestions, testimonials, reviews, or other feedback, you agree that we can use and share such feedback for any purpose without compensation. We may remove, edit, or refuse to publish any User Content at our sole discretion.


14. SERVICES MANAGEMENT

We reserve the right, but not the obligation, to:

  • Monitor the Services for violations of these Legal Terms.
  • Take appropriate legal action against violators, including reporting to law enforcement and regulatory authorities.
  • Refuse, restrict, limit, or disable access to any portion of the Services.
  • Remove content that is excessive, harmful, offensive, or burdensome.
  • Cooperate with law enforcement, regulatory agencies, or court orders as required.
  • Otherwise manage the Services to protect our rights, property, and the safety of our users.

15. TERM AND TERMINATION

WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO THE SERVICES TO ANY PERSON FOR ANY REASON OR FOR NO REASON.

If we terminate your account: (a) you are prohibited from creating a new account; (b) all pending orders may be cancelled; (c) you remain liable for all charges incurred prior to termination; and (d) we reserve the right to pursue all available legal remedies.

Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, limitations of liability, indemnification, and dispute resolution provisions.


16. FORCE MAJEURE

Fifty 410 Health shall not be liable for any failure or delay resulting from circumstances beyond our reasonable control, including acts of God, pandemics, government actions, drug shortages, supply chain disruptions, regulatory enforcement actions, pharmacy closures, cyberattacks, labor disputes, war, terrorism, or civil unrest.


17. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove any aspect of the Services at any time without notice. We will not be liable for any modification, price change, suspension, or discontinuance of the Services, including discontinuation of any medication offering due to regulatory changes.


18. GOVERNING LAW AND JURISDICTION

These Legal Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles, except that the Federal Arbitration Act governs Section 19. This choice of law does not deprive you of protections that cannot be waived under the law of your state. Subject to Section 19, any court proceeding must be brought in a court with lawful jurisdiction and venue. Eligible small-claims matters may be brought where permitted by the applicable small-claims rules.


19. DISPUTE RESOLUTION

19.1 Mandatory Pre-Dispute Resolution

Before initiating any formal dispute, you agree to first contact Fifty 410 Health at [email protected] and attempt to resolve the dispute informally for at least thirty (30) days. A notice should include your name, contact information, a description of the dispute, and the relief requested. Any filing deadline is paused during this 30-day period to the extent permitted by law.

19.2 Agreement to Individual Arbitration

A “Covered Dispute” is any claim between you and Fifty 410 arising out of or relating to the Services, these Terms, a purchase, a communication, or the parties' relationship, whether the claim arose before or after you accepted these Terms, except for the matters expressly excluded in Section 19.7.

EXCEPT FOR THE MATTERS LISTED BELOW OR IF YOU TIMELY OPT OUT, YOU AND FIFTY 410 AGREE TO RESOLVE COVERED DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION. THE FEDERAL ARBITRATION ACT GOVERNS THIS AGREEMENT. BY AGREEING TO ARBITRATION, EACH PARTY WAIVES THE RIGHT TO A JUDGE OR JURY TRIAL FOR COVERED DISPUTES.

19.3 Rules, Administrator, and Hearing

Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, as modified by these Terms. Information is available at adr.org/consumer. If AAA is unavailable or declines to administer the case, the parties will select another administrator or ask a court to appoint one under the Federal Arbitration Act. The arbitration may occur by telephone, video, written submissions, or in person near where you live, unless the parties agree otherwise.

19.4 Arbitration Fees and Remedies

Filing, administration, and arbitrator fees will be allocated under the AAA Consumer Arbitration Rules and applicable law. Fifty 410 will pay fees it is required to pay for this arbitration agreement to be enforceable. Each party is responsible for its own attorneys' fees unless a statute, rule, or award permits recovery. The arbitrator may award any individual remedy available in court and will issue a reasoned written decision. Claims remain subject to the limitation periods supplied by applicable law.

19.5 Right to Opt Out

You may opt out of this arbitration agreement by emailing [email protected] within 30 days after first accepting these Terms. Include your full name, the email address associated with your account, and a clear statement that you opt out of arbitration. Opting out will not affect your access to the Services or any other part of these Terms.

19.6 Class and Representative Action Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, COVERED CLAIMS MUST BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY AWARD RELIEF ONLY TO THE INDIVIDUAL PARTY SEEKING RELIEF.

19.7 Exceptions and Severability

Either party may bring an eligible individual claim in small-claims court. Claims for emergency injunctive relief, intellectual-property misuse, public injunctive relief where applicable law requires court access, and any claim that applicable law does not permit to be arbitrated are excluded. A court, rather than an arbitrator, will decide whether this arbitration agreement exists or is enforceable. If part of this Section is unenforceable, it will be severed and the remainder enforced, except that if the class or representative-action waiver cannot be enforced for a particular claim, that claim will proceed in court. A material change to this Section will not apply to a dispute for which either party had actual notice before the change was posted.


20. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT ANY RESULTS OR OUTCOMES WILL BE ACHIEVED.


21. LIMITATIONS OF LIABILITY

IN NO EVENT SHALL THE COMPANY PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU DURING THE SIX (6) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

These limitations apply only to the fullest extent permitted by law. They do not apply to liability for gross negligence, reckless or willful misconduct, fraud, death or bodily injury, a privacy or security breach to the extent liability cannot lawfully be limited, or the violation of any non-waivable consumer right. They also do not limit a professional-malpractice claim against an independent Provider, pharmacy, or other licensed professional. Nothing in these Terms limits liability that applicable law does not allow the parties to limit.


22. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify the Company Parties against a third-party claim to the extent caused by:

  • Your knowing and material breach of these Terms.
  • Your unlawful misuse of the Services or prescription medication.
  • Content you submit that unlawfully infringes a third party's intellectual-property or privacy rights.
  • Your negligence or willful misconduct that causes the third-party claim.

This section does not apply to an honest consumer review, a good-faith billing or consumer-protection dispute, professional malpractice or bodily injury caused by a licensed professional, or a claim caused by a Company Party's own negligence, gross negligence, willful misconduct, or violation of law. It does not require indemnification where prohibited by applicable law.


23. USER DATA

To the extent permitted by law, Fifty 410 is not responsible for data loss caused by events outside its reasonable control. This section does not limit the privacy, security, breach-notification, or liability obligations described elsewhere in these Terms or imposed by applicable law.


24. ELECTRONIC COMMUNICATIONS

You consent to receive electronic communications from us. You agree that all electronic communications satisfy any legal requirement that such communication be in writing.


25. SMS TEXT MESSAGING (MOBILE MESSAGING TERMS)

25.1 Program Description

Subscribers will opt-in via www.fifty410.com/get-started to receive verification messages from Aspen Aesthetics, LLC, dba Fifty 410 Health through its messaging service providers. Message frequency may vary per user.

Text “HELP” for help. Text “STOP” to cancel.

Message and data rates may apply for any messages sent to you from us and to us from you. Carriers are not liable for delayed or undelivered messages.

25.2 How You Opt In

Enrollment is entirely voluntary and requires your express consent. You opt in by entering your mobile number and affirmatively checking the SMS consent box on our website, by texting a keyword to our number, or by giving written consent on a patient intake or consent form. The checkbox is never pre-checked. The opt-in states that you will receive verification messages, includes the disclosures “Message and data rates may apply. Message frequency varies. Reply HELP for help. Reply STOP to cancel,” and links to these Terms and to our Privacy Policy. We maintain records of consent.

CONSENT TO RECEIVE TEXT MESSAGES IS NOT A CONDITION OF PURCHASING ANY GOODS OR SERVICES, AND IS NOT A CONDITION OF RECEIVING MEDICAL CARE.

25.3 Opting Out (STOP)

You may cancel at any time by replying STOP to any message from us. After you send STOP, we will send one final message confirming that you have been unsubscribed, and you will receive no further messages unless you opt in again. You may also opt out by emailing [email protected] with your mobile number.

25.4 Getting Help (HELP)

Reply HELP to any message for assistance, or contact us at [email protected]. Support is available without creating an account or logging in.

25.5 Supported Carriers and Carrier Liability

The Program is available on major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your wireless carrier and is not guaranteed.

25.6 Eligibility and Your Responsibilities

You must be at least 18 years old and the subscriber or authorized user of the mobile number you provide. You agree to notify us promptly if you change or relinquish that number so we do not text its next owner.

25.7 Privacy

Information collected through the Program is handled in accordance with our Privacy Policy and, where applicable, the HIPAA Notice of Privacy Practices provided by your treating Provider or dispensing pharmacy. No mobile numbers will be shared with third parties or affiliates for marketing or promotional purposes, and text messaging originator opt-in data and consent will not be shared with any third parties. Standard text messaging is not a secure or encrypted channel; by opting in you acknowledge that messages we send may be viewed by anyone with access to your device.


26. CORRECTIONS

We reserve the right to correct any errors, inaccuracies, or omissions at any time without prior notice.

You agree to comply with all applicable laws in connection with your use of the Services. Fifty 410 Health reserves the right to cooperate fully with any law enforcement authority or regulatory agency.


29. MISCELLANEOUS

These Legal Terms, together with our Privacy Policy, Telehealth Informed Consent, the applicable Provider or pharmacy HIPAA Notice of Privacy Practices, and Refund Policy, constitute the entire agreement between you and Fifty 410 Health. Our failure to enforce any provision shall not operate as a waiver. We may assign our rights at any time. If any provision is unenforceable, it is severable. No joint venture, partnership, or employment relationship is created.
